The Black Car Fund (“BCF”) is a not-for-profit organization for New York’s rideshare (e.g., Uber or Lyft) drivers and/or drivers for other Black Car Fund Member Bases. We provide a range of educational, safety and health resources at NO COST to eligible enrolled drivers.

The Black Car Fund surcharge is a state-mandated small fee that passengers - NOT DRIVERS - pay on every ride. The surcharge goes into The Black Car Fund to pay for all our valuable benefits and programs, like Drivers Benefits.

All eligible New York For-Hire-Vehicle drivers, including drivers for Uber, Lyft, and The Black Car Fund’s other Member Bases can sign up, for free, to receive a valuable Health and Wellness Drivers Benefits. These benefits are available at NO COST to eligible NY FHV drivers because they are paid for by The Black Car Fund.

¹You must meet Eligibility Requirements for your Sweepstakes entry to be valid and to enroll in Drivers Benefits. For 2024, an eligible driver is either: (i) a driver who is registered with the New York City Taxi and Limousine Commission (NYC TLC) as a driver for a Black Car service and in the prior calendar year has proved service to passengers averaging at least 10 hours per week during the most recent available calendar quarter, with such hours measured from the time a passenger enters a vehicle until such passenger exits the same vehicle, or (ii) a driver is not registered with the NYC TLC and who qualifies as a Transportation Network Company (TNC) or is affiliated with a dispatch base that is a member of The Black Car Fund and in the prior calendar year has received a gross income of at least $4,000 during the most recent available calendar quarter from the provision of service to passengers in the State of New York.Gross revenue is determined based on income that will be reported on a driver's Form 1099. These eligibility standards may be changed by The Black Car Fund upon at least 30 days' notice. Enrolled drivers must continue to meet eligibility requirements to maintain access to the benefits.

Sweepstakes Period: Entries to The Black Car Fund - Drivers Benefits $500 Gas Card Drive & Thrive Sweepstakes (the “Sweepstakes”) will be accepted starting on February 15th ,2024 at 12:01 am EDT and ending on March 31,  2024 at 11:59 pm EDT (the “Sweepstakes Period”). Sponsor’s computer system is the official timekeeping device for the Sweepstakes.

 

Sponsor: Affinity Insurance Services, Inc., 1100 Virginia Drive, Ste 250, Ft. Washington, PA 19034 (“Sponsor”).

 

How to Enter: During the Sweepstakes Period, each individual who provides their first name, last name, TLC (Taxi Limousine Commission) number (or Driver’s License number if no TLC), phone number and email address will be automatically entered into the Sweepstakes.   Limit one (1) sweepstakes entry per person

 

Limitations on Entries: LIMIT ONE ENTRY PER PERSON. No third party entry or entry through sweepstakes service is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage false entries, as determined by Sponsor will be disqualified. Use of robotic entries is strictly prohibited. 

 

Agreement to Rules: By participating in the Sweepstakes, you confirm that you have read, understand and agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements in Section 5 below. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the Sweepstakes.

 

Eligibility: The Sweepstakes is open to individuals (i) who are eligible drivers for one of The Black Car Fund’s Member Bases (which include New York Uber, Lyft, and other Black Car Fund Member Bases)., and (ii) are legal residents of the United States who are at least eighteen (18) years of age, or at least the age of majority in their place of residence, whichever is greater.

 

Governmental Officials and any other individuals who are unable to accept the Prize described in Section 6 as a condition of their employment are not eligible to participate in this Sweepstakes.  For the purpose of these Official Rules, the term “Government Official” means: (a) anyone who is employed by an entity that is owned (either entirely or in part), controlled or directed by a government or sub-part thereof; (b) an officer or employee of a government or any department, agency, or instrumentality thereof, including state-owned or state controlled commercial entities; (c) an officer or employee of a public international organization, such as the United Nations, World Bank or International Monetary Fund or International Red Cross; (d) any person acting in an official capacity for or on behalf of any government or department, agency or instrumentality or public international organization; (e) any political party official; (f) any candidate for political office; (g) any employee or officer of the Native American Tribes, Aboriginal or First Nations groups, tribal councils, and enterprises owned or controlled by such administrations; (h) any other person, individual or entity at the suggestion, request or direction or for the benefit of any of the above-described persons and entities.

 

The Sweepstakes is not open to employees, officers, or directors of Sponsor, The Black Car Fund and the Workers Benefit Fund or each of their respective agents, administrators, affiliates, partners, subsidiaries, distributors, parents, sales representatives, Prize suppliers, advertising and promotion agencies, wholesalers and retailers, printers and any other suppliers to Sponsor, and their immediate family members (parents, spouse, siblings and children and their respective spouses regardless of where they live) and individuals living in the same household (whether related or not) are not eligible to participate. The Sweepstakes is void where prohibited by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

 

Prize: There will be eight (8) Prize winners (“Winners”) for the Sweepstakes Period. Each Winner will receive one or more gas cards totaling five-hundred-dollar ($500) (the “Prize”).

Prizes must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise. A cash equivalent gift card is prohibited. The Prize is subject to standard gift card terms and conditions. Sponsor will not replace any lost or stolen Prizes. To the extent permitted by law, Sponsor makes no representations or warranties with respect to the Prizes. Sponsor may be required by law to report Prize values to taxing authorities. Winners will be responsible for all taxes (federal, state, and local of all applicable jurisdictions) and all expenses not listed herein related to acceptance and use of any Prize.

 

Odds: The odds of winning depend on the number of eligible entries received.

 

Winner Selection and Notification: On or about twenty (20) days after the end of the Sweepstakes Period, eight (8) potential winners will be selected from all eligible entries by a random drawing conducted by Sponsor. Sponsor will attempt to notify the potential winners via email (the “Notification”) and phone (the “Notification”).

 

Return of any Notification as undeliverable, inability to reach a potential winner or failure of a potential winner to respond to a Notification within ten (10) days, failure to provide proof of eligibility (if requested) or other required documentation in a timely manner, refusal of the Prize, or other non-compliance with these Official Rules may result in disqualification, forfeiture of the Prize and, at Sponsor’s sole discretion, selection of an alternate eligible entrant for the forfeited Prize by a random drawing from all remaining eligible entries received, who will be subject to disqualification in the same manner. Receipt by a Winner of a Prize is conditioned upon compliance with any and all federal, state, and local laws and regulations.

 

Rights Granted by Winner: By accepting a Prize, a Winner grants to Sponsor and its designees the right to use and publish their name, voice, picture, likeness, biographical information, statements, and any written comments provided to the Sponsor for advertising, promotional and other purposes, worldwide and in perpetuity, in any media, now known and hereafter devised (including and without limitation, the internet) without additional compensation except where prohibited by law.

 

Limitation of Liability and Release: BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANTS AGREE THAT SPONSOR, AND ITS AFFILIATES AND EACH OF THEIR PARENT COMPANIES, RESPECTIVE OFFICERS, DIRECTORS, MANAGERS, EMPLOYEES, SUBSIDIARIES, AFFILIATED ENTITIES, MEMBERS, SHAREHOLDERS, DIVISIONS, PREDECESSORS, SUCCESSORS, REPRESENTATIVES, ASSIGNS AND ATTORNEYS, (COLLECTIVELY, THE “RELEASED PARTIES”) HAVE NO LIABILITY WHATSOEVER FOR, AND ENTRANTS SHALL HOLD THE RELEASED PARTIES HARMLESS AGAINST, ANY LIABILITY FOR ANY INJURIES, CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES OF ANY KIND (INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM (A) ENTRY OR PARTICIPATION IN THE SWEEPSTAKES, (B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR PRIZE DELIVERY, OR (C) THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE.

Entrants acknowledge and agree that the Released Parties do not have any responsibility or liability whatsoever for: (a); unauthorized human intervention in any part of the entry process or the Sweepstakes; (b) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (c) any property loss, damage, personal injury, or death, in connection with any Prize provided pursuant to the Sweepstakes and/or any person’s participating in the Sweepstakes; (d) any printing or typographical errors in any Sweepstakes-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, damaged or indecipherable entries; or (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software (if applicable).

 

General Conditions: Participation constitutes full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor which are final and binding. The award of a Prize is contingent upon fulfilling all requirements set forth herein in a timely manner.

 

The Sweepstakes and Official Rules shall be governed by interpreted in accordance with the laws of the State of Illinois without regard to any conflict of laws principles. Jurisdiction and venue of any dispute concerning a Prize, the Sweepstakes or these Official Rules shall be vested solely in the appropriate courts within the State of Illinois. All federal, state and local laws and regulations apply. Subject to any governmental approval that may be required, Sponsor reserves the right to, without prior notice and at any time, modify or terminate the Sweepstakes, in whole or in part, should any factor interfere with its proper conduct as contemplated by these Official Rules. In such case, Sponsor may select Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.

 

All participants hereby grant Sponsor a non-exclusive, worldwide, royalty-free right and license to use all materials submitted in connection with the Sweepstakes for any purpose, including commercial purposes, that Sponsor may deem beneficial.  In no event will Sponsor be obligated to award more than the stated number of Prizes offered.

 

Privacy: Any information collected from the Sweepstakes entry may be used for commercial purposes consistent with these Official Rules and with Sponsor’s Online Privacy Policy which can be found at https://www.aonaffinity.com/privacy-policy/ .

 

The Black Car Fund (“BCF”) is a not-for-profit organization created by New York State to provide workers' compensation insurance to drivers of NY Black Car Services including Uber, Lyft, and the more traditional Black Car bases in the industry. BCF also provides safety and health programs that benefit these for-hire drivers, including the Drivers Health Benefits Program that features Dental Insurance, Vision Coverage, Telemedicine, Personal Accident Insurance, Accident Disability Insurance Plan, $100K Non-Work Accident Death Benefit, Critical Illness Insurance, discounts on Urgent Care and Prescriptions, and more, at no cost to eligible drivers. All the benefits paid for by BCF are funded entirely by the small surcharge that is paid by passengers on each ride. While we encourage all eligible drivers to participate, participation is entirely voluntary, and you are not required to participate. None of the benefits are intended to provide you with any rights of employment or to otherwise affect your status as an independent contractor with respect to BCF or with the dispatch base you are affiliated with. If you are an employee driver, none of the benefits paid for by BCF are sponsored or endorsed by your employer. None of the benefits are intended to be covered by the Employee Retirement Income Security Act (ERISA) or the Patient Protection and Affordable Care Act (“PPACA”). The Black Car Fund reserves the right to revise or terminate these benefits in whole or in part at any time, and for any reason.
